摘要
对医患纠纷是否具有可仲裁性的争论现已基本划上句号,即大多数医患纠纷具有可仲裁性。然而,对如何构建医事仲裁机制方面仍存在一定的争议,假如采用选择性(一裁终局型)仲裁模式来处理医患纠纷,如何兼顾公正与效率的问题仍有待探讨。本文在详尽论述医事仲裁为什么不宜采用强制性(仲裁结果非终局性)仲裁模式的同时,重点探讨了一裁终局制度下的医事仲裁可以通过聘请医法结合型的仲裁员、改革仲裁庭的架构、设立自身纠错机构以及制定医事仲裁指南等措施来兼顾公正与效率的统一。
Debate on the arbitration of medical dispute now ended,that is,most of the medical disputes can be arbitrated.But debate still exist on how to build the medical arbitration mechanism.If selective arbitration mode(arbitration award shall be final and binding)to deal with medical disputes is adopted,how to balance justice and efficiency remains to be discussed.This paper discussed in detail why should not adopt mandatory medical arbitratin mode,meaning arbitration award shall be not final and binding.The single ruling system of the medical arbitration can be implemented by hiring arbitrators with medical and legal knowledge,reforming the structure of the arbitration tribunal,setting up its own error correction mechanism and measures,such as establishing the medical arbitration guidelines,to ensure the unity of justice and efficiency at the same time.
