摘要
改革开放以来,随着家庭教育法律法规的相继制定,我国家庭教育的法制化进程经历了模糊表述、明确规定、系统规划、专门化、社会化等五个阶段。本文不仅对家庭教育法律法规的内容规定进行了详细解读,而且对家庭教育法制化的构成要件进行了系统分析,据此揭示了我国家庭教育法制化进程中存在的阻力因素,由此有针对性地提出了我国在制定家庭教育法时需注意:转变固有观念,家庭教育由私人领域到公共领域;结合我国民间习惯法,制定特色的家庭教育法;关注家庭中的现实问题,制定有针对性的家庭教育法;重视社会弱势群体,制定公平正义的家庭教育法。
Since the reform and opening-up, a series of laws and regulations on family education have been enacted. The legislation of family education in China has undergone five stages:vague interpreta-tion, clear stipulation, systematic planning, specialization and socialization. This paper elaborates on the content of these laws and regulations, and systematically analyzes indispensable factors as well as resistance factors in the legislation process. On this basis, it gives suggestions on the enactment of family education law in China. Our stereotypical ideas must be changed by transferring family educa-tion from the private sphere to the public one. Based on our social conventions, we should make family education law with Chinese characteristics, targeting realistic problems in family life. More attention to the disadvantaged is needed to ensure the fairness of our family education law.
