摘要
针对目前我国法律严格限制宅基地使用权流转与城镇化进程中其强烈的流转需求相背离,进而导致的隐性流转市场的盛行与其流转不规范的现实,将研究视角对准天津市宅基地使用权流转实践基地,采用实地调研与文献分析的方法分析天津市流转模式现状及其形成原因,并对天津市宅基地流转模式进行分析评价,同时结合其他各地的流转模式进行了流转规制模式的拓展研究,以期为全国其他地区的宅基地流转实践提供参考。
In order to solve the deviation of the demand in our national law about strictly limiting the circulation of the use right to rural homestead from the strong demand of circulation in the process of urbanization,which results in the prevalence of recessive circulation market and the irregular of circulation,this paper focuses on the practical base of use right circulation of Tianjin homestead. By means of practical survey and literature analysis,the status and formation of circulation model in Tianjin are analyzed and understood,followed by the evaluation on the model. Meanwhile,an expanding study about the circulation regulation model is carried out combined with circulation models of other practical bases. It is hopeful that expanding research about the homestead circulation models can be applied to the future practice of homestead circulation all over the country.
