摘要
近年来,我国社会发生了一系列食品安全丑闻,不仅严重威胁了消费者的健康权益,也对政府的执政合法性提出了挑战。随着经济—社会结构的转型,传统国家主导下的食品安全"一元治理"模式呈现出"内卷化"趋势。为此,必须重构食品安全治理体系。新的食品安全治理机制应当嵌入到"推进国家治理体系和治理能力现代化"的进程中来考察,运用国家、市场与社会的合力来进行社会共治。但对于"食品安全社会共治何以可能与何以可为"这一基本问题,国内学界尚无系统研究。国家向社会释放和自身再造是食品安全社会共治的前提;社会的发育与成长是食品安全社会共治的基础;而国家、市场与社会之间的协调是食品安全社会共治的关键。在这一体系中三大行为主体作为平等伙伴,通过动态协调方式推动食品安全的有效治理。
The recent years saw series of scandals about food safety in our country,which not only threaten the consumers' health rights and benefits,but also challenge the legality of the administration. With the transformation of economic and social structure,the 'unitary governance'model shows the tendency of ‘involution'under the auspices of traditional state. Therefore,the food safety governance system must be restructured. The new governance system should be embedded in the process of 'pushing the modernization of national governance system and capacity'. And we should construct a governance system which depends on the pool efforts of the state,the market and the society. But domestic academic community has no systematic research concerning 'how can it be possible to conduct co- regulation,and why can it be done'. The national releases to society and self- reconstruct are the premises of co- regulation in food safety governance; the social development and growth are the foundations of co- regulation in food safety governance; the coordination of the state,the market and the society is the key point of co- regulation in food safety governance. These three subjects are the equal partners in this system,pushing forward the effective governance of food safety by way of dynamic coordination.
