摘要
对于民办图书馆是否应该纳入《公共图书馆法》,四位专家各抒己见。郭斌认为,近年来民营图书馆有了长足发展,并在公共文化服务体系中扮演着重要角色,但是其发展还存在瓶颈,需要政府以立法的形式给予保障。柯平提出,民办图书馆是对我国各地公共图书馆的一个重要补充,但是其作为公共图书馆事业的组成部分是有条件的,可将民办图书馆的公共服务纳入"公共图书馆法"范畴,并按照公共图书馆事业的原理对其予以规范。王子舟指出,公共图书馆的构成要素主要是依法设立和免费开放,而办馆主体并非根本区别,不能将政府出资作为"公共图书馆"的构成要件。他力主将民间图书馆纳入《公共图书馆法》,并列出5点理由,同时呼吁对其设立、职能、运行、扶持等内容作出具体规定。翟建雄则认为,不能幻想一部《公共图书馆法》解决所有问题,提供公共图书馆服务目前仍主要是政府的责任,民办图书馆情况复杂,其发展情况并未达到公共图书馆标准,为利于其今后的发展,目前不宜列入《公共图书馆法》。
Whether the private library should be incorporated into The Public Library Act or not,the four experts express their opinions.Mrs.Guo Bin thinks that the private library has achieved significant development in recent years,and plays an important role in the system of public cultural services,but there is still existing development bottleneck,and needs guarantee in the form of legislation by the government.Mr.Ke Ping puts forward that the private library is an important supplement to public libraries in different areas of China,but there are conditions to view it as a public library,and we can incorporate the public services of private libraries into the 'public library law' while normalizing them according to the principles of public librarianship.Mr.Wang Zizhou points out that the inscapes of the public library are establishment according to laws and free open for the public,but not the body of establishing libraries,so we can't regard funding by the government as a constitutive requirement of 'public library'.He strongly advocates to incorporate the private library into The Public Library Act based on five reasons,and calls on specific provisions for its establishment,functions,operation,support,and so on.Mr.Zhai Jianxiong considers that we can't use one law of The Public Library Act to solve all problems,and providing public library services are still the responsibility of the government at present,while the conditions of private libraries are complicated and their development states fail to the standards of public libraries,and it's not fit to incorporate the private library into The Public Library Act for the present considering its development of the future.
