摘要
劳动法存续的利益基础决定着它必须将私法性规范与公法性规范驾驭在同一法律体制之下,达到公私双赢。我国现有的两套劳动执法体系便是为贯彻劳动法的这一目的而设定的。然而实践中,这两套体制却存在功能上的失位:以劳动仲裁为主要内容的劳动争议处理制度没有有效发挥其私权救济功能,以劳动监察为核心的劳动行政执法制度也没有很好地发挥其公权救济功能。重塑劳动执法体制的功能是必要的,也是国际劳动公约对我国劳动立法和执法体制的要求。
The interests of the labor law survival foundation decide it must control private law and public law under the same legal system,to achieve public and private win-win. The existing two sets of labor law enforcement system have been set for the purpose of implementing the labor law. In practice,however,the two sets of system loss their functions: labor arbitration as the main content of the labor dispute processing system without play effective use of its private right relief function,labor inspection as the core of the labor administrative law enforcement system is not very good use of its public rights relief function. It is necessary to restore the functions of the labor law enforcement system,also is the requirement of the international labor conventions to China's labor legislation and law enforcement system.
