摘要
农地"三权分离"改革为促进农村发展注入了新的活力,然而机遇与挑战往往并存。土地经营权入股合作社的基本理论研究依然薄弱,其依据的法律制度及相关配套措施滞后,对农民权利保护不健全等问题依然制约着我国特色农业现代化的发展。以修改《农民专业合作社法》为契机,探索土地经营权入股合作社的物权化属性发展,实现合作社类型的统一化,促进现代农业经营体系的构建。
With the reform of ＂separation of three rights＂ in rural land, this is an？opportunity？to boost？rural？development as well as a challenge. These different issues, the weak basic theory of studying on investment to the cooperative by the management rights of rural land, the basis of legal system and related supporting measures lag, the unsound institution of protecting farmers＂ rights, still restrict the development of characteristic agriculture modernization in China. It is an opportunity that modify the farmers＂ professional cooperatives law to explore the investment to the cooperative by the management rights of rural land in development of real property, to achieve reunification of the cooperative type, and promote the construction of modern agricuhural management
