摘要
厘清土地整理监管的基本原则有助于就土地整理监管主体、客体、内容、模式、责任及相关法律规范之设定、完善做出恰当、及时、正确的指引,进而推动科学构建土地整理监管机制以实现对我国土地整理活动的有效规制。应以依法监管原则为土地整理监管原则的逻辑起点,以可持续性监管原则为土地整理监管原则的终极目的,以监管一致性与差异性相协调原则为土地整理监管原则的基本手段,以严格规制原则为土地整理监管原则的根本保障。
To clarify the fundamental principles of land consolidation supervision can help to make appropriate,timely and correct guideline to the subjects,objects,contents,patterns,liabilities and the related legal norms’ setting and improving,thus promoting the establishment of land consolidation supervision mechanism to achieve effective rule and regulation to the land consolidation activities of our country.The land consolidation supervision should keep to the principle of supervising according to the law as the logical basis;the principle of sustainable supervision as the ultimate aim;the principle of coordinating regulatory consistency and difference as the basic method;the principle of strict rule and regulation as the fundamental guarantee.
