摘要
随着金融危机的爆发,越来越多国家中央银行法规定中央银行具有维护金融稳定的职责。尤其是《中国人民银行法》第2条规定,"中国人民银行……制定和执行货币政策,防范和化解金融风险,维护金融稳定"。传统上,中央银行的货币政策目标往往被定位于货币稳定。对于金融稳定与货币稳定的法律关系,可以认为,维护金融稳定是中央银行的目的性职能应居于主导地位,反映《中国人民银行法》的立法目的与根本追求;而保障货币稳定则是中央银行的工具性职能,是《中国人民银行法》规定的中央银行为实现其目的性职能应具备的基本属性或共性职能。《中国人民银行法》所规定的中央银行职能是一个由多层面职能构成的有机系统,体现着工具型职能与目的性职能的统一:中央银行目的性职能统率、整合中央银行的动态运作,反映出中央银行的本质追求;反之,中央银行要实现其目的性职能,必须依靠工具性职能的支持与具体实施,工具性职能无疑是目的性职能的实现手段与实现方式。
The eruption of the financial crisis has led a growing number of national central banks to take the responsibility of assuring financial stability according to the law on the central bank of their countries. Especially, the article 2 of the Law on the People＇s Bank of China ordains, The People＇s Bank of China shall, under the leadership of the State Council, formulate and implement monetary policy, prevent and mitigate financial risks, and maintairl financial stability. Traditionally, the target of monetary policy of the central bank was styled as currency stability. The legal relationship of financial stability and currency stability could be considered as what assuring financial stability is the aiming responsibility of central bank and should be domi- nant, showing the legislation and the basic goals of the Law on the People＇s Bank of China ; as the instrumental responsibility, assuring the currency stability is the basic attribute and common responsibility of central bank, should play an important role in achieving the aiming responsibility which was provided by the Law on the People＇s Bank of China. Granted by Law on the Peo- ple＇s Bank of China, the responsibility of central bank is an organized system consisted of multidimensional duties, embodying the combination of the aiming responsibility and the instrumental responsibility： the aiming responsibility dominants and integrate dynamic operation of the central bank, explaining the essence of the responsibility of the central bank. ; On the other hand, central bank can not achieve the aiming responsibility without the implement of the instrumental responsibility, which means, the instrumental responsibility is the inevitable means to achieve the aiming responsibility.
