摘要
以被害人学为视野,从刑事被害人这一角度出发,把握被害人身份这一关键词,软化以犯罪人为中心的量刑论,适当突出被害人身份的独立量刑价值。重点探讨被害人身份对责任刑和预防刑的影响以及被害人分担责任的独立性,还原被害人身份应有的量刑主体性。
In perspective of victimology and from this point of criminal victims, the writer try to grasp victims status, soften the theory of criminal - centered sentencing and appropriately highlight value of the independent sentencing of the victim identity. This paper focus on victims status＇s impact on sentencing of criminal prevention and criminal responsibility and the independence of victims on responsibility - sharing and restore sentencing subjectivity of victims status .
