摘要
网络虚拟财产作为一种新型的财产形式,同样具有一般财产的物权属性和财产属性,可以作为公民遗产继承的客体。但网络虚拟财产由于其自身的特殊性,在作为遗产继承时与传统现实财产的继承具有明显的区别。在我国未来修改《继承法》时,应当注意加以区别与保护,并通过立法作出专门规定,以维护和平衡用户(即被继承人)、用户继承人、网络服务提供商的合法权益。
As a new form of property, the network virtual property have the same real right attribution and property attribution as general property, can be inherited by citizens. However, owning to its own particularity, network virtual property is obviously different from traditional real property when it is inherited as heritage. Therefore, when amending Succession Law of China, we need to distinguish it from others and protect it; we should make special regulations by law to safeguard and balance the rights and interests of ancestors ~ successors and ISP.
