摘要
儿童福利权作为我国法律上确认并加以保障的重要权利之一,在当下的中国如何获得更好的保障,不仅是应对制度困境的需要,更是我们公法学人需要关注的课题。从目前我国儿童福利权保障的法律框架来看,相关内容极为分散且略显凌乱,其实现面临诸多困境。儿童福利权保障法制化的解决之道在于更新儿童福利权理念、尽快制定儿童福利基本法、建立专门儿童福利行政管理机构。
How to make the children welfare right, one of the important rights recognized and protected by the national legislation, be fully guaranteed at present in China is not only essential to deal with the institutional plight, but is also a project needed to be focused on by us, the public law scholars. From the viewpoint of legal framework for China national children welfare right protection, the related contents are scattered and appear to lack connections and are fraught with difficulties in realization. The solution to the legalization of welfare right protection for children lies in updating the concept of welfare right of children, legislating for basic law on children＇s welfare and setting up specific administrative institutions in charge of children＇s welfare.
