摘要
在农村中构建集体经营性建设用地流转制度,提高农村土体利用率,依法保护农民权益,是社会和谐稳定发展的重要保障。该研究从权利归属及土地权能本质,土地流转的基本条件、方法及流程,个人、集体、国家的利益分配,建设公平、统一的土地流转市场等4个方面对农村集体经营性建设用地流转制度的构建进行了详细阐述,为我国农村合理分配用地提供参考。
In the rural areas,the construction of collective management land transfer system improve the utilization rate of rural soil,protect the rights and interests of farmers according to law,it is the important guarantee for the harmonious and stable development of the society. This paper is mainly about the construction of rural collective management system of land transfer system from four aspects of right attribution,basic conditions,method and process of land transfer,individual,collective,national interests distribution,construction of fair and unified land transfer market,the purpose is to provide a reference for the reasonable allocation of rural areas in China.
