摘要
哈贝马斯的法律合法性思想在西方合法性思想中独树一帜。它以交往理性为核心,以主体间性、动态性、程序性为主要特征,其中的程序性以程序主义法范式得以展现。哈贝马斯的法律合法性思想相较于自然法学派和分析法学派,有独到和明显的创新之处,它并不是以伦理道德或者法律文本来证成法律的合法性,而是将商谈民主作为法律获得认同和尊重的终极理由。哈贝马斯法律合法性思想的价值就在于促进法治认同、保障公民人权、健全协商民主。
In the western legal thoughts, Habermas＇ s legal legitimacy is unique and important. Its core is com- municative rationality. It is characterized by subjectivity, dynamic, procedural. Procedure is showed to the procedural- ist paradigm of law. Compared with the Analytical School of law and Natural law school, it has a unique and obviousi- nnovation, it is not use the moral or legal texts to prove the legitimacy of the law, but use deliberative democracy as the ultimate reason to recognize and respect the law. Its value lies in the promotion of legal identity, the protection of human rights, and the perfection of the deliberative democracy.
