摘要
我国《侵权责任法》中赋予了被侵权人以精神损害赔偿请求权,保护了公民的精神利益,作为与民事侵权相对的国家侵权领域也迫切需要对被侵权人的精神利益进行救济与保护。2010年《国家赔偿法》修正案中对此项制度作出了规定,但由于赔偿标准不明确、赔偿范围过于狭窄等多种原因,司法实践中的国家侵权精神损害赔偿的适用引起了不少争议。下文从《国家赔偿法》的规定出发,结合世界代表国家的立法经验,分析我国国家侵权精神损害赔偿的现状与不足,以期提出一些看法与完善建议。
China＇s Tort Libility Law endues the right of applying for compensation for spiritual damage,protecting the citizens＇spirit interests.As the relative areas to civil tort,state infringement also needs the protection of citizens＇spirit interests.The State Compensation Law Amendment promulgated in 2010 stipulated this system,but in practice this system caused many dis-putes due to reasons such as the indeterminate compensation standard and narrow compensation scope.Based on the provisions of State Compensation Law,the author combine other representative countries＇legislative experience in this article and analyse present situation and deficiency of the state infringement spiritual damage compensation in our country ,then put forward my proposals and views.
