摘要
在行政审批缩量改革背景下,传统意义上的行政许可正逐步为第三方认证所替代。第三方认证机构事实上在经济、社会生活中承担了市场失灵和社会管理干预者的角色,其独立于供方与买方,具有缓解市场失灵、降低交易费用、协作监管的功能。从社会中间层主体理论的视角,在探讨第三方认证机构经济法主体地位基础之上,阐释了第三方认证权的社会权力属性及基本特征,为政府规制实践提供认识论基础。
Under the background of shrank reform of administrative examination and approval,traditional administrative licensing system is gradually replaced by the third party certification. In fact,independent of the suppliers and buyers,the third party certification bodies play the intervenor role of the market failure and social rmanagement, to relieve market failure, reduce the transaction cost and cooperatively regulate. This paper,from the perspective of social intermediary body theory,based on analysis of the principal position of economic law,illustrates the social authority attributes of the third party certification and basic characteristics,providing epistemological basis for our government regulation.
