摘要
公众参与是环境影响评价的重要内容之一。自2002年《环境影响评价法》以法律形式确定环境影响评价公众参与以来,我国环境影响评价公众参与制度逐步完善,形成了以法律为基础、部门规章为准则、囊括规范性文件和行业标准的完整体系。近年来,关于环评公参的调查范围、调查比例、代表性和反对率存在很多争议,然而很多属于对于公参办法的误读,环评承担了很多公众的期望,使得社会各界对于环评公参的理解产生偏差。从现行的环评公参制度来看,能够做到程序与内容符合相关规范要求的公参即为合格的公参。环评公参背后涉及的更多的是利益博弈问题,需要各利益相关方的共同参与,才能获得较好的效果。
The public participation is one of the most important contents in EIA. Since the public participation of EIA was confirmed in accordance with EIA law in 2002, the public participation system of EIA has been improved gradually, forming a complete system including the normative documents and industry standards. Recently controversies occur in survey range, survey proportion, representative and opposing rate on public participation of EIA, however, most arguments could be regarded as the forced misreading on public participation measure of EIA. EIA has undertaken many public expectations, which cause the deviation from correct understanding on public participation of the public. From the view point of the current public participation system of EIA, the public participation is qualified when procedures and contents meet the requirement of relevant codes. The background of public participation of EIA involves interests of games, and the various stakeholders should participate in the public participation of EIA in order to get a better effect.
