摘要 3D打印人体器官技术是3D打印技术与生物技术的有机结合。该技术近年来发展迅速,在解决生命科学中诸多问题的同时,也引发了社会伦理问题,并且其获得专利授权的正当性面临挑战。将3D打印人体器官的法律属性界定为人格物,是对其存在的伦理风险的化解之道。3D打印所得到的人体器官本身及其方法具有可专利性,在适用专利"三性"授权标准时应当体现该技术的特殊性。我国应当对制定生物技术领域的专利授权政策采取积极态度,但又需对审查标准严加把握,以缓解专利授权中技术发展与伦理规范之间的矛盾。 3D printing human organ technology is an organic combination of 3D printing technology and biotechnology. This technology has developed rapidly in recent years, and it has also raised the issue of social ethics in the process of solving the problem of life science. The patentability of the technology faces challenge. The legal attribute of 3D printing organs, which should be deemed as property with personality, is to resolve the ethical risks. The human organs acquired by 3D printing and its method are patentability, and the application of novelty, non-obviousness and usefulness standards should reflect its special nature. Our country should develop biotechnology patent protection policy with a positive attitude, but need a strict patent standard, in order to alleviate the contradiction between technology development and ethics in the ifeld of patent granting.
