摘要
尊严是当代世界各国宪法文本及实践中的核心概念,然而在理论体系上,它也面临实证化程度不一、概念模糊和价值冲突等挑战。完成尊严理论自身的体系化是应对这些挑战的关键。尊严来自人反思、评价进而选择自己生活的基本属性,由此可以发掘尊严概念的最基本含义。尽管由于宪法实践及其环境的差异,各国将尊严实证化的程度不同,仍然可以"宪法保护尊严的方式"为标准将之提炼为尊严理论的形式体系,并从其核心意义出发建构一个融贯的内容体系。这样一个抽象的双重体系,需要通过宪法解释实现保障范围具体化与价值判断理性化两个核心目标。中国宪法上的尊严条款,在形式上体现为"内部统摄与外部相互构成的规范地位",规范含义上则体现为一种对君子人格的追求与国家伦理的拟人化塑造。
Dignity is the key concept in contemporary constitutional text and practice around the world. In theory, however, it is also faced with such challenges as different degrees of positive analy- sis, vague concepts, and value conflicts. The systematization of the theory of dignity itself is the key to meeting these challenges. Dignity comes from the fundamental capacity of human beings to reflect on, evaluate and choose their own way of life. As such, it has three layers of basic meaning, namely the meaning in terms of ontology, relationship theory, and constitutive theory. Although, because of the differences in the constitutional practice and its environment, the degree of positive analysis of dignity varies from one country to another, it is still possible to extract from such practice a formal system of dignity theory by taking "the constitution protection of dignity" as the standard, and con- struct a coherent system of content, substance and value from the three groups of core meaning. Such an abstract dual system needs constitutional law interpretation to achieve two core goals :concretization of the sphere of protection and rationalization of value judgment. Finally, under this theoretical frame- work, the dignity clause in Chinese constitutional law is embodied formally in "the normative position constituted thorough the interaction between internal and external factors" and essentially in the pursuit of gentleman' s personality and anthropomorphic shaping of national ethics.
