摘要
通过对相关法规政策和文献资料的梳理,归纳出我国企业工会所扮演的3种角色——维稳、维序、维权。这3种角色分别代表了3种不同的责任期望,即为政府维稳、为企业维序和为职工维权,概括了在劳动争议中企业工会所面临的角色冲突,以及这种角色冲突对工会职能作用发挥的影响。采用质化研究方法,通过对9家企业36名工会干部、管理人员和普通员工共计30.3小时的深度访谈,运用主轴编码和内容分析技术,分别从企业工会组织层面和工会干部个体层面深入分析了工会角色冲突对工会作用发挥的负面影响。在此基础上,提出在企业工会维权与维稳和维序的多重角色辩证统一关系中,应以维权为基础和前提,企业工会组织建设的相关制度设计应进行适当改进,有效防止"行政工会"和"老板工会"等对策建议,从而消除企业工会角色冲突,充分发挥企业工会的作用。
Based on the analysis of relevant Chinese laws and the review of related literatures,this study examines three roles which CETUs play,that is,preserving social stability(weiwen),maintaining normal production order(weixu),and protecting the legitimate rights and interests of workers(weiquan).These three roles represent three types of responsibilities and expectations from three different entities—government,employers and employees.Therefore,CETUs are facing role conflicts in labour disputes and these role conflicts have a negative impact on their performance of functions.To verify this supposition,30.3hours of interviews were conducted with a total of 36 interviewees including trade union cadres,managers and employees from 9Chinese enterprises.Through axial coding and content analysis,the interview results have been explored to analyze the negative impacts of CETUs' role conflicts on their function performance both at the organization level of CETUs and at the individual level of union cadres.The results of this study suggest that CETUs should take weiquan(for workers' rights)as a priority and fundamental responsibility over weiwen(for social stability)and weixu(for production order),and therefore CETUs should be relatively independent to enterprise management to prevent CETUs becoming"unions of administration/management"or"unions of owners",which may help CETUs to reduce role conflicts and have a full play to their functions.
