对电子游戏的直播涉及向公众传播游戏中的影视作品和音乐作品。判断未经许可的直播是否侵权,不应以是否影响电子竞技产业发展为依据,而取决于其是否构成合理使用。对游戏画面的直播通常不是为了单纯地再现画面本身的美感或所表达的思想感情,而是展示特定用户的游戏技巧和战果,因此具有转换性。同时游戏直播不会替代欣赏直播的用户对运行游戏的需要,对游戏市场的影响是有限的。因此对游戏画面的直播可以构成合理使用。
