摘要
专利运用促进了专利市场价值实现,却可能对专利制度的技术激励产生冲击与削弱。基于过强价值实现的战略性运用导向可能引发专利动机改变,加剧专利质量评价的不确定,更容易产生因权力滥用而引致的社会福利损耗。能够发挥最大化效用的专利运用政策需要平衡专利技术激励和市场价值,在专利制度体系中还原真实的技术激励,在创新驱动发展战略下做好政策统筹协调。
Patent use promotes the patent value in the market, but has negative impact on the technology incentives on patent system. Strong market-oriented strategic patent use may lead to some changes on patent motivations, it can also exacerbate uncertainty on patent quality evaluation, and more likely to trigger social welfare loss if abuse behaviors generate. The optimal patent use policy should balance the patent value and technology incentive. It is very important to strengthen the patent mechanism on patent use, coordination different policies in the innovation driven development in China.
