摘要
按照《一带一路愿景》构想,东亚经济圈和欧洲经济圈将通过贯穿欧亚非大陆的陆地与海上丝绸之路连接。以中国沿海港口为起点的"一带一路"国际海上货物运输网络使中国海上货物运输高度国际化和模式多元化,同时构成了对中国现行规则体系的挑战。现有生效的国际公约不能有效地统一多式联运规则,但《鹿特丹规则》构建了一套新的规则体系。《中华人民共和国海商法》实施至今已有二十多年,已不能满足航运发展而有效地解决国际多式联运引发的法律问题,当然也无法应对"一带一路"多式联运所引发的各类法律问题。因此,中国在发展"一带一路"多式联运的同时,必须加快多边或双边国际海上货物运输规则体系构建和参与的步伐,以确保"一带一路"战略的成功。
According to China's One Belt and One Road Initiative,East Asian economic zone and European economic zone will be linked through Eurasia and the Silk Road on the Sea. The network of international carriage of goods by sea in One Belt and One Road,starting from Chinese coastal ports,will highly internationalize China's maritime transport and diversify its modes. At the same time,it brings challenge to Chinese existing rules system. Currently the international conventions in effect cannot effectively unify rules on multimodal transport,while Rotterdam Rules come to build up a new set of rules system. It has been twenty years since Maritime Code of the People's Republic of China came into force. The Code has been incapable of addressing legal issues arising from international multimodal transport,and apparently it cannot cope with issues emanating from the multimodal transport on One Belt and One Road either. Therefore,when China has been busy in building One Belt and One Road multimodal transport,it has to equally speed up its pace on the participation and establishment of bilateral or multilateral rules and regulation system on international carriage of goods by sea,in order to make sure One Belt and One Road strategy get successful.
