摘要
由于公共政策制定者与行政裁量实施者具有高度重合性,以及相较于法律规范公共政策具有灵活多变等品性,使得公共政策在行政裁量中一直担当着至关重要的角色。公共政策进入行政裁量过程之中,能够对行政裁量起到提升行政效率与裁量怠惰、政策规避等正反两方面的效应。据此将公共政策在行政裁量中应有的角色定位界定为公共政策是特定条件下的行政裁量依据,行政裁量自我规制的准则,并以规范性文件的前置审查制度保障公共政策的合法性、民主性和科学性;以裁量基准制度实现公共政策对行政裁量的正确引导;以司法审查制度保证行政裁量中政策适用的公正性来规范作为行政裁量考量依据的公共政策,促进行政裁量权的正当行使。
Public policy plays a vital role in administrative discretion for its flexibility and its makers' high-degree overlapping with the implementers of administrative discretion. Applying public policy in administrative discretion can both improve administrative efficiency and inhibit discretion laziness and policy circumvention. According to this,this paper defined public policy as the foundation of administrative discretion under certain circumstances. Moreover,judicial review system can be used to regulate public policy by ensuring its impartiality,so as to promote the legitimate exercise of administrative discretion.
