摘要
作为中国特色社会主义法律体系的组成部分,我国海关法律体系的运行历史较为长久且完整。审慎考察我国现行海关法律体系可以发现,其在某种程度上也存在立法疏漏、立法冲突等问题,客观上也需要在立法理念、立法模式等领域予以变革。消解现行海关法律体系中的立法冲突等问题,确实需要顺应时代发展要求,更新立法模式,积极、主动地参与国际海关立法,理论上也需要借助违宪审查等机制来增强海关法律体系的统一性、系统性。
As a component of China＇s legal system,customs legal system has a long and complete history. A careful examination of China＇s current legal system may reveal that there also exist flaws and conflicts in legislation to some extent. Thus objectively speaking,it is necessary to seek for reforms in philosophy and mode of legislation. But the elimination of the conflict occurring in current customs legislation calls for following the development of times,upgrading the mode of legislation and actively and voluntarily involving the international customs legislation. In theory,it is required to scrutinize the legislations against the Constitution,so as to improve the uniformity and comprehensiveness of customs legal system.
