摘要
农村土地承包权与经营权的再分离是当前深化农村土地改革中的一项重要内容,其变革不仅对农村经济、社会发展产生重大影响,还会加快城乡一体化的建设进程。农村土地承包权和经营权的再分离打破了原有权利的构架,分离后两权各自负载功能出现严重的差异。因此,为了实现两权的有效分离,需要构造现代化的法制体系,在法律和制度上全面支持农村土地改革的顺利展开。
To re-separate the rural land contract right from that of management is an important content of deepening the reform of rural land system and its change will not only bring about great effect on rural economy and social development,but also accelerate the process of integrating the urban and rural construction. However,the re-separation will break up the original rights framework,and some serious difference will occur in the functions that each right is operating. So in order to realize the effective separation between the two rights,there is a need to construct a modern legal system to fully support a smooth development of the rural land reform.
