摘要
本文对链接技术分析的基础上,提出以技术标准对链接分类的方法来判断行为是否属于受控的网络传播行为,无助于认定行为性质。针对深层链接行为直接侵权的认定标准,本文在分析服务器标准和用户感知标准后,提出以"内容实质呈现为原则,以合法授权或播放器跳转为例外"的认定方式。
The paper analyzed the Link technology, proposed that taking the technology standard to classify all kinds of link do little to recognize the nature. After analyzing the server standards and the user perception standards, the paper proposed that following the substantive content presentation as guiding principle and taking legally authority or jumping to other player as exceptions to identificate the direct infringement with deep-level link.
