摘要
1978~1999年,作为重要的地方行政制度,地区行署曾对新时期的各项建设起了不可或缺的重要作用,而目前对其职权的研究难见究竟。地区行署本应是执行督导、检查职权的派出机构,中央和地方对其均有督导检查职权的规定,但由于自新中国成立以来缺乏关于地区行署专门的组织法和必要的明确规定,加之政府主导型经济社会管理模式的深刻影响,因此,地区行署不可避免的在企事业管理权、县级主要经济指标制定权、人事任免权、机构编制审批权、辖市权等方面或多或少地超规越限,最终出现不仅仅执行了督导、检查职权的结果。
As an important local administrative system during 1978~1999,Local Administrative Office played an indispensable role in the constructions in the new period,but the study about its powers is hard to see at present.Local Administrative Office should be an agency of exercising supervision and inspection authority,the Central and the local have the regulations on the supervision and inspection powers.But because of lacking of special organic laws and necessary and clear regulations and the profound influence of the government-oriented economic and social management mode,as a result Local Administrative Office inevitably went beyond its powers and regulations in management rights of enterprises and institutions,formulation rights of the main economic index at the county level,appointments and removals of personnel,rights to the jurisdiction of the city and so on,which led to not only perform the rights of supervision and examination.
