人工智能创作物获得版权保护的合理性 被引量:166

The Rationality of Copyright Protection for Creation Generated by Artificial Intelligence

摘要 人工智能的发展已经使得文学艺术领域作品的创作不再为人类所垄断,同时也引发了这一类型创作物是否可以构成作品并获得版权保护的争论。为了对这一问题进行初步的探讨,首先,有必要针对人工智能技术的类型与发展历程予以介绍,试图理清人工智能及其创作物的本质属性。其次,文章将综述当前部分国家与国际组织针对人工智能创作物的可版权性、权利归属等一系列问题的态度。再者,文章将从激励论和市场竞争的角度对是否应授予人工智能创作物以版权保护的不同政策选择的利弊进行分析。最后给出结论。 With the technical progressin artiifcial intelligence ifeld, the creation of literary and artistic works is no longer monopolized by human beings. This situation brings about debates about whether this kind of creation should be regarded as the “work” in copyright law and get copyright protection. In order to inquire into this question, it’s necessary to introduce the types and development history of artificial intelligence at ifrst, attempting to ifgure out the essence of artiifcial intelligence and its creation. Secondly, we shall review some countries and international organizations’ attitudes about creation generated by artificial intelligence. Then, it’s reasonable to analyze different policy choices’ advantages and disadvantages concerning about copyright protection for creation generated by artificial intelligence from the viewpoint of the market competition and incentive theory. Based on the above-mentioned discussion, we will give the conclusion finally.
