摘要
我国各地开展的宅基地置换事关我国新农村建设的成败,涉及到农户住宅的拆迁补偿、农村宅基地整理复垦及集中安置区规划建设等问题,德国农村建设中所体现的保护农户利益及古村落历史文化遗产的考虑值得我国借鉴。文章主要运用文献研究及问卷调查等具体研究方法,通过阐述德国在农村建设中"将土地整理与村庄更新有机结合、以完善的法律法规与科学规划为依据、依托公众的有效参与"等经验做法,反思我国宅基地置换中"地方政府片面追求宅基地的节约集约利用、缺乏立法支持与规范、缺少公众有效参与"等不足,进而得到"要在提高农民生活质量和保护古村落的前提下开展宅基地置换、完善立法以规范宅基地置换的开展及保障公众有效参与"等启示。
The homestead replacement carried out in China is related to the success or failure of the new rural construction, it involves the removal compensation for farmers＇ houses and homestead, the arrangement and reclamation of homestead, the planning and construction of centralized resettlement areas, then the experiences to protect the interests of farmers and the cultural heritage of ancient villages in the rural construction in Germany are worth learning. By using the specific research methods of literature study and question- naire survey, the article expatiates the experiences of rural construction in Germany, which include carrying out land arrangement and village renewal coherently, depending on the perfect laws and regulations and scientific planning, relying on the effective participation of the public, further, it analyzes the deficiencies of the homestead replacement in China, which include local governments one-sided pursuit of saving and intensive use of homestead, the lack of legislative support and norms, the lack of effective participation of the public. In the end, the enlightenment about homestead replacement are obtained, they are： carrying out homestead replacement in the premise of improving the life quality of farmers and protecting ancient villages, perfecting legislation to regulate the homestead replacement and ensure the effective participation of the public.
