摘要
设立科学规范的法官遴选制度是建设正规化、专业化和职业化法治专门队伍中不可缺少的一块基石,对于维护司法公正、树立司法权威起着重要的作用。我国目前法官遴选制度的主要弊端在于法官资质要求偏低、遴选程序过于笼统和缺乏遴选相应配套制度。我国台湾地区法官遴选制度起步早,已经形成了完整的法律规范与程序。因此,总结与借鉴台湾地区的立法实践,可以为大陆地区今后相关的立法提供有益的启示与参考,有助于早日形成维护司法公正的法律职业共同体,推动实现法治中国建设进程。
It’s an indispensable cornerstone to establish a scientific and standardized system of selection of j udges in the team formation of the legal department based on regularization,specialization and professionalization.Meanwhile,it’s very important to maintain judicial justice and establish judicial authority.But the judges’ low qualification in selection,too general selection procedures and the lack of appropriate supporting systems are the main drawbacks of the selection system of j udges in our country at present.The selection of j udge system starts early so that it has formed complete legal norms and procedures in Taiwan Region.Therefore,it can provide useful inspiration and reference for related legislation in the mainland of China in future to sum up and draw lessons from the legislative practice in Taiwan Region,which helps to form a legal professional community to safeguard judicial justice and promote the process of building the rule of law in China.
