摘要
当代中国,在法治逐渐成为无可置疑的社会主流话语的同时,从官方到民间,也慢慢地滋长出了一种可称之为"法治浮夸风"的政治社会气息,并已经非常显明地形成了可以称之为"法治大跃进"的思想与实践行动的社会现象。"法治时间表"的制作设置、政府主导"法治指数"的设计与应用、"口号"法治、"运动"式法治,就是法治大跃进典型的现实表现。本文揭示了中国法治大跃进得以产生的根本原因,并从革命的浪漫主义、民粹主义、偏狭的政治经验主义、教条主义、法律工具主义、唯意志论、唯科学主义、革命论、国家主义和政治意识形态十个方面,对中国法治大跃进展开了思想批判;同时从中国共产党依法执政进行法治政党建设、法治政府建设、法治社会建设、法治国家建设四个方面,对中国法治大跃进进行了实践批判;提出了必须对中国的法治建设抱持理性务实的态度、保持足够的耐心与克制,坚持踏实而坚定地循序渐进地不断推进中国的法治建设的基本立场。
In contemporary China,it is no doubt that rule of law has been gradually becoming the main social discourse,at the meantime,a political and social tang which may be called＂the grandiloquent atmosphere in rule of law＂has been growing slowly,and it has distinctly become the social phenomenon which may be called＂the Great Leap Forward in rule of law＂in theory and practice. Designing＂the timetable of rule of law＂,＂the index of rule of law＂designed and applied by governments,the rule of law expressed by the slogans,the rule of law expressed by the movements,all these are the realistic typical examples of＂the Great Leap Forward in rule of law＂in China today. The article reveals the reasons why＂the Great Leap Forward in rule of law＂happened in China,and has criticized＂the Great Leap Forward in rule of law＂in China on the level of ideas from different dimensions such as the revolutionary romanticism,the Populism,the biased political experimentalism,the dogmatism,the legal instrumentalism,the voluntarism,the scientism,the revolutionary theory,the nationalism,and the political ideology. The article has criticized＂the Great Leap Forward in rule of law＂in China on the practice from different dimensions such as the Communist Party of China＇s being at the helm of the state and constructing the political party in rule of law,constructing the governments by law,constructing the society with rule of law,constructing the legal state. The article proposed the constructing legal state in China must be on the rational and pragmatic attitude,keep enough patience and restraint,and insist on the basic standpoint which promotes the rule of law in China steadfastly,unhesitatingly,gradually and step by step.
