摘要
民生问题的本质是权利问题,与社会权基本对应,但民生绝不等同于社会权,民生内涵大于社会权,二者在功能上表现出极大的关联性,民生改善和社会权保障相互促进、互具工具性功能。从民生改善的工具性功能看,民生改善推动社会权品格重铸;从社会权的工具性功能看,保障社会权以架构民生结构。民生改善与社会权保障之关系定位有助于消解关于民生与社会权的认知迷点、促进民生问题的解决和强化社会权保障的力度与质量。
The essence of the people's livelihood issues is the rights issue that basically corresponds to social rights,but the people's livelihood is not totally equal to social rights. The people's livelihood means much more than social rights,but they have great relevance as far as the function,which means that the improvement of the people's livelihood and the guarantee of the social rights are mutually promoted,and both of them have the instrumental functions. In the respective of the function of the people's livelihood improvement,it stimulates the social characters recasting while the social rights helps to build people's livelihood structure. The relationship between the people's livelihood and social rights contributes to clearing up the cognitive puzzle of people's livelihood and social rights. As a result,the relationship will help to resolve the people's livelihood issues and strengthen the quality of the social rights guarantee.
