摘要
鼓励社会组织参与体育公共服务供给是我国公共服务领域创新的重要制度安排。由社会组织代替传统模式下的政府,成为体育公共服务供给的生产者,将市场竞争机制引入行政管制策略,商业性契约约束取代权力制约,在此过程中实现政府角色的转换及服务职能的聚焦。理论分析表明,由公众、政府和承接服务供给的社会组织共同组成双重多级委托代理关系链,通过各行为主体间关系的重塑,有利于推动各主体间的互动合作,促进体育资源合理配置,产品结构优化,实现社会功能互补。然而,结合上海市体育公共服务供给改革实践研究发现,主体间利益冲突以及责任关系混乱、信息不对称和道德风险的同时存在、契约不完备、公平性和政府公共责任的缺失,都使得本就不甚成熟的社会组织参与体育公共服务供给更加步履维艰。当政府的行政权力管制仍是主要力量,承接服务的社会组织变成政府行政职能的延伸,合同约束难以实现对各主体的利益协调时,现行参与模式就已经背离了体育公共服务市场化供给的初衷。建议以公私合作模式代替目前的契约购买模式,构建主体间信任与合法性认同,以多主体价值实现目标代替目前单一绩效目标作为服务供给结果评价的依据,可以成为未来我国体育公共服务改革的路径选择。
Encouraging social organizations to participate in the supply of sports public services is an important institutional vehicle, which as one part of the public service innovation. Social organizations become producers in the supply chain of sports public service instead of the government. Traditional admin- istrative regulations should carry out reforms to introduce market competition mechanism. To bind into the service of another by indenture starts to be valued, but not power restriction. During this process, a clear system of social participation and the role of government could be set up. In theory, dual and multiple level principal-agent chain is made by the public, government and social organizations in service supply system. It will be conducive to promote the mutual cooperation among different subjects, rational allocation of sports resources and product structure optimization to realize social complementary functions. How- ever, the case study from Shanghai explained that interest conflicts between the main body, information asymmetry, incomplete contract and inadequate pub- lic responsibility could cause embarrassment for social organizations. Executive power is still a major incentive in most occupations. Social organizations are the specific undertakers of government function. Reliance on contractual constraints to achieve coordination of the interests of different subjects is admirable but impracticable. Current participation mode has deviated from the original intention of the market supply in sports public services. The paper proposed that public-private partnership model should be taken instead of the present purchase model with contract. Based on building trust and legitimacy identity system among subjects, service qualities should be measured by the plural value orientation.
