摘要
国际化是期货市场本质属性,是期货市场功能发挥的基础条件之一,而期货市场国际化必然要求法治化。随着"一带一路"国家战略的实施和自贸实验区的建立,特别是近年来中国期货市场自身不断发展壮大,中国期货市场国际化已势不可挡。但目前我国关于期货公司、投资者和期货品种的准入制度等方面存在准入门槛过高、双向交流不够畅通、程序繁琐和不够透明等问题,严重阻碍了中国期货市场国际化进程,影响我国期货市场在国际大宗商品上的定价权和话语权,为此需要从法治化路径入手,完善期货立法,优化期货市场国际化法治环境,实行负面清单管理,降低市场准入门槛,优化市场准入程序,完善相应的风险防控机制,维护国家金融安全,保证中国期货市场国际化有序开展。
Internationalization is the essential attribute of the futures market, and it is one of the basic condi- tions for exerting the function of the futures market, whereas the internationalization of futures market in- evitably requires the legalization. As our country implements the national strategy of ＂the Belt and Road＂and establishes the pilot free trade zone, especially China＇s futures market develops rapidly in recent years, the in- ternationalization of China＇s futures market is irresistible. But now there are some serious problems in access system of futures companies, investors and futures varieties, such as higher barriers to entry, insufficient com- munication in bilateral trade, complex program and lack of transparency. These hinder the process of the fu- tures market＇s internationalization and impact on pricing and the right to speaking in the international futures commodity market. To solve these problems, we need to start from legalization, by improving futures legisla- tion, optimizing the legal environment in the futures market＇s internationalization, implementing negative in- ventory management, reducing the market access barriers, optimizing the market access program, establishing an appropriate risk control mechanism, safeguarding national financial security to ensure an orderly interna- tionalization of China＇s futures market.
