摘要
"排除合理怀疑"标准是英美法系国家的产物。虽然2012年我国《刑事诉讼法》将"排除合理怀疑"标准纳入其中,我国学者也对此做了大量的研究,但对"排除合理怀疑"含义的理解仍存在模糊不清的情况。"排除合理怀疑"应该是"方法",而非"立场";"排除合理怀疑"当是一种"证明要求",而不是"证明标准"。科学合理的"排除合理怀疑"证明要求机制包括可操作的内部机制和有效的外部监督机制两部分。
＂Beyond a reasonable doubt＂ standard is a product of the common law countries. In 2012, China＇s criminal procedure law, ＂beyond a reasonable doubt＂ standard included, which reflects the progress of our legislation. Around this time, Chinese scholars have done a lot of research, and the outcomes are a- chieved. But the ＂beyond a reasonable doubt＂ understanding of the meaning of ambiguous situations still ex- ist. This article will try to ＂stand and method of dialectical materialism＂ again on both ＂beyond a reasonable doubt＂ interpretation of the meaning, and on this basis, explore scientific and reasonable operational internal and external control mechanisms in order to solve the problem of standard of proof in practice is difficult to grasp.
