摘要
"行政性"与"协议性"是行政协议的典型特征,然而二者之间的融合与冲突却造成了它长期"有名无实"的"身份尴尬"。行政协议理论研究试图为它"正名"和消除该尴尬,并直面热点,审视问题,促使二者的良性互动,该等努力与愿望在行政协议制度近三十年的发展进程中得到了见证。
