摘要
告密现象,古已有之,史不绝书。古代告密制度作为强化权威、维护统治的手段,在打击犯罪等方面发挥了一定的积极作用。如今的"揭发型"立功制度与"告密"在客观上表现一致,但二者在行为主体、行为方式以及行为后果等形式层面渐次相异。出于趋利避害的本能和利己的本性,"揭发型"立功制度在刑事执行中出现了异化和变相,唯有转变观念,辨明证据,完善监督制度,才能维护"揭发"型立功制度的司法公正。
Whistleblowing had been existed in our country since ancient times. As the means to reinforce the authority, ancient whistle-blowing system played a positive role in fighting against crimes. Today^s meriting system by exposing and ancient whistleblowing share the objective similarities, but they are different in behavioral agents, patterns and consequences. With the instinct of avoiding disadvan-tages and egoism, the meriting system by exposing appeared dissimilation in criminal execution. Therefore, some measures are taken to maintain the justice such as changing concepts, identifying evidences, and improving the supervision system.
