摘要
现行强制隔离戒毒制度正面临诸多质疑,而公安机关在现行戒毒模式中扮演了至关重要的角色,破解强制隔离戒毒所面临的困境首先要解决公安机关权力与责任配置方面出现的问题。公安戒毒中的权力与责任关系总体处于失衡状态,分别体现于权力与积极责任的关系、权力与消极责任的关系之中。应借鉴权责平衡理论的相关理念,从健全积极责任的引导功能、发挥积极责任的规范功能、完善相关责任配置、强化责任追究机制等几个方面重新构建平衡的权责运行体系。
The current forced isolation for drug addiction treatment is facing lot of questions, but public security authorities play a key role in the current addiction treatment mode. To solve the dilemma faced by forced isolation for addiction treatment needs firstly solve the problems appearing in the construction of public security authorities＇ rights and rcsponsibilities. The relation between rights and responsibilities of public security authorities for addiction treatment are in unbalanced state generally, respectively reflected in the relation between rights and positive responsibilities and the relation between rights and negative responsibilities. Such measures should be done to reconstruct a balanced operation system of rights and responsibilities like perfecting the guiding function of positive responsibilities, fulfilling the normative function of positive responsibilities, completing construction of relevant responsibilities, strengthening accountability mechanism.
