摘要
本文从专利、标准、标准必要专利的定义和内涵入手,分析专利和标准的对立和统一关系,进而通过分析铁道建筑行业专利和技术标准的特点,研究在我国铁道建筑行业建立标准必要专利机制的必要性和可行性。
This paper analyzed the relationship with opposite and unity between technical standard and patent by the definition and connotation of patents, technical standard, standard essential patents. And through the analysis of the characteristics of the railway construction industry patent and technical standard, it also studied the necessity and feasibility about establishing standards essential patents mechanism in railway.
