Research on Individual Privacy Protection in Open Government Data in the UK

摘要英国个人隐私保护不仅体现在相关法律法规中,而且还体现在各种开放数据政策当中,法律法规与政策相辅相成。在政府数据开放许可方面,英国采用了英国国家档案馆制定的开放政府许可协议,这使得英国对可豁免开放数据规定更为自主,并且信息专员办公室的存在让个人隐私保护体系更加完善。但其也存在着不足,如缺少专门的个人隐私保护法。我国应从个人隐私保护的法律法规、政策、政府数据开放许可协议以及个人隐私保护机构层面着手,构建一个相对完善的、多层次的个人隐私保护体系。 In the United Kingdom, individual privacy protection embodies not only in relevant regulations, but also in open data policies, while regulations and policies could not be separated from each other. UK Government Licensing Framework established by the National Archieves makes UK more autonomy in free open data, and Information Commissioner＇s Office （ICO） would perfect privacy protection system.There still exists deficiency, such as lacking special legistion on individual privacy protection. China should construct a relatively perfect and multi-level individual privacy protection system based on individual privacy protection legislation, policy, open govement data licensing and individual privacy protection institution.
