摘要
技术移民法的核心制度主要由技术移民政策、技术移民主管部门、技术移民的评估、技术移民的权利与义务,以及技术移民的相关法律制度组成。我国应当稳步坚持并完善"以我为主、按需引进、突出重点、讲求实效"的技术移民总政策,以构筑我国好客的新型移民国家的完整制度为总方向,不以大规模使用"国籍"与"永久居留权"作为吸引国际技术移民的手段,而是以欢迎并善待远方来的客人为总态度,努力在国家需要的岗位上创设有国际竞争力的吸引国际人才的局部环境,通过编制引进国外人才的职业(专业)名录这种现代"招贤榜"的方式为我国建立和完善技术移民评估制度提供基础,加强使用法律法规对技术移民的权利与义务进行规定,适时开展对双重国籍问题的研究,完善驱逐出境的规定,尽快制定我国的技术移民法,努力为我国的社会经济发展争取更加有利的国外智力资源。
The key systems in the Law of Immigration for Technical Personnel shall be principally composed by the parts of the policy, competent authorities, evaluation systems, rights and obligations, as well as related systems for the immigration for technical personnel （ITP）. The author of this paper holds that China shall take ＂Initiation by Us, Introduction on Demand, Highlights with Importance and Emphasis on Efficiency＂ as its general policy for ITP, oriented towards the general direction of constituting the complete system for a new--type of immigration country of hospitality. China shall not massively take its ＂nationality＂ and ＂permanent residence＂ as the token to attract international skilled workers. Rather, its general attitudes for these workers shall always be welcoming and friendly with improved internationally competitive packages for the working position where the state needs. The List of Occupation or Profession for International Skilled Workers shall become the basis for the evaluation system for ITR. The rights and obligations of ITR shall be further clarified in the laws and regulations. The author also advocates that the research on the possibility of double nationality shall be carried out, that the regulations on deportation shall be improved and that the law for ITP shall be soon promulgated, in order to win more international intelligent sources for the Chinese social and economic development.
