摘要
新的中国海警局虽已组建,但目前缺乏赋予其刑事侦查主体资格的法律依据。实践证明,中国海警具备享有刑事侦查主体资格的现实必要性。刑事诉讼问题非常严肃,需要通过修改旧法或制定新法等法律途径,以明确规定中国海警的刑事侦查主体资格。
Although the new China Coast Guard has been established, so far, the law is still not clear whether it has the right to criminal investigation. However, it has been granted with the reality of the necessity in practice. The problem about criminal procedure is very serious, and it is necessary to revise the old law or formulate a new law so as to clearly stipulate the subject qualification of criminal investigation of the China Coast Guard.
