摘要
海派文化与中国近代法制的历史渊源极为深厚。海派电影、海派建筑、海派法学等海派文化典型代表的诞生与发展就是中国法制近代化影响下的杰作。海派文化因为兼容并包、融贯中西、注重法制,是最容易为西方世界所接受的中国文化。上海在对外文化交流方面有着丰富的历史经验,借助上海自贸区的种种优势可以让海派文化走向世界的战略更上一层楼。无论从海派文化发展的历史经验层面还是从国际主流价值观认同方面看,法治都是上海自贸区推广海派文化的必由之路。尽管这条路面临着法制与法治的历史鸿沟、上海自贸区的法治改革、上海自贸区与内地的法制对接等问题;但是只要国家能够继续推动上海自贸区的文化产业法治改革,充分保障上海自贸区的司法公正,海派文化产业自身就能够树立文化产业的国家意识、提高从业人员的法律素质,海派文化走出去战略一定会大有作为。
There is deep origin betweenShanghai-style culture and Chinese modern legal system. Under the influence of the modernization of Chinese legal system, Shanghai-style culture which includeshang- hal-style film, shanghai-style building, shanghai-style law and so on began to be born and develop. Be- cause Shanghai-style culture is characteristic of compatibility, well-versed in both Chinese and western culture, emphasizing ruling by law,it become the most acceptable Chinese culture for other countries.In addition,Shanghai which possess rich experience in external exchange can make a further progress in the help of Shanghai Pilot Free Trade Zone. Whatever from the aspect of historical experience or from the respect of international acception of mainstream values, the path to rule of law is the only way to spread shanghai-style culture, Though confronted with the matters of historical gaps,legal reformation, legal connection between shanghai and interior areas, Shanghai-style culture can make great contribution to the whole society,if our country can continue to promote the legal reformation of cultural industries in Shanghai Pilot Free Trade Zone, fully protect judicial justice, equip the cultural industries with na- tional awareness and improve the legal quality of Relevant personnel.
