摘要
法官惩戒制度是规范法官行为、防止司法不公、提高司法公信力的重要手段。但近几年法官违法违纪现象严重,我国现有法官惩戒制度的现实功能遭到质疑。尤其是在司法体制改革的大背景下,越来越强调法官审判的独立性,如果没有完善的法官惩戒制度对法官的行为予以监督和制约,更容易滋生司法腐败。因此,针对我国现行法官惩戒制度中存在的缺少权威立法依据、惩戒主体不中立、惩戒事由缺乏统一标准、惩戒程序不规范等问题,应当在尊重审判规律的基础上,根据法官职业特点,对我国法官惩戒制度进行构建完善,以指导实践操作。
Being an important measure of regulating judge action and curbing judicial corruption,judge disciplinary system has been widely questioned in recent years. Especially in the background of judicial reform,the lack of supervision in consummate judge disciplinary system can lead to judicial corruption. In order to solve the problems such as lack of authoritative legislative basis,non-neutral disciplinary body,shortage of uniform standards and irregular procedure,judge disciplinary system on the basis of judicial professional characteristics has to be constructed to instruct judicial practice.
