摘要
建立和完善司法责任制是司法体制改革的"牛鼻子",对其他各项司法改革均具有牵引和统领作用。司法责任制的核心要义和科学内涵是"让审理者裁判,由裁判者负责"。司法责任制与司法民主制是相辅相成的,在推进司法责任制改革的过程中应重视发挥合议庭、审判庭、审判委员会以及法官专业会议等司法民主载体的积极作用,不断创新完善以司法民主保证司法公正、司法权威、司法秩序、司法公信的体制机制。习近平关于司法和司法权、司法的价值和功能、司法规律等基础理论问题的深刻论述,为司法责任制改革提供了科学理论,指引司法责任制改革在司法本质和司法规律的轨道上有序推进。
To build and improve the system of judicial responsibility is the key point in the reform of judicial system,playing the pulling and leading role in other judicial reforms. The core essence and scientific connotation to build the system of judicial responsibility is ＂ entitling the inquisitor to make adjudication and the adjudicator to take relevant responsibility＂. System of judicial responsibility and judicial democracy are supplementary to each other. In the process of carrying forward the reform of system of judicial responsibility,it＇s necessary to pay attention to the active effort played by the carriers of judicial democracy,such as collegiate bench,adjudication division,judicial committee and professional meeting of judges. And there is need to innovate and perfect the system mechanism of judicial democracy constantly,thus ensuring the implementation of judicial justice,judicial authority,judicial order and judicial integrity. General Secretary Xi Jinping＇s profound discussion on the basic theoretical problems of judiciary,judicial power,value,function,and its laws have provided scientific theories for the reform of system of judicial responsibility,guiding its reform promoting orderly in the judicial essence and laws.
