摘要
由于农地使用权存在产权主体不明确和物权不完整等缺陷,农地所有权抵押模式难以直接应用于使用权抵押。本文对越南和泰国的农地使用权抵押贷款运行模式及其成效进行比较分析发现:由于产权性质的内在缺陷以及政策限制,农地使用权抵押价值较低;法律和政策支持是农地使用权可抵押的重要前提条件,但过度干预会影响农地使用权抵押的可持续发展;要使农地使用权良性发展需要注重对失地农民的保护。据此,中国应完善法律法规和相关配套政策,充分发挥市场机制的作用,因地制宜地发展多种类型的农地经营权抵押贷款。
Since mortgage of land use right has defects such as unclear property right and incomplete real right,mortgage of land ownership is difficult to be applied directly to land use right.The paper compares the mode and performance of land use right mortgage in Vietnam and Thailand and results are as follows:because of policy limitations the collateral value of land use right is low and likely to be underestimated;legal and policy support is an important precondition for land use right mortgage,but excessive interference may hinder its sustainable development;landless peasants should be protected to keep the sound development of land use right mortgage.Accordingly,the law and related policies should be further improved,the market mechanism should play the basic role and various types of mortgage loan on land management right should be taken by local conditions.
