摘要
中央关于街区制方案引发了封闭式小区是否应当开放的争论。支持开放者从城市交通、规划等宏观角度讨论街区制之利,反对者强调业主物权与生活便利。少有人注意到开放小区很可能是解决现有封闭式小区物业管理矛盾的路径。本文认为,封闭式小区特别是大中型封闭式小区居住模式是造成现在物业管理乱象背后的结构性因素。封闭式小区模仿当初单位大院而建立。单位大院具有品质与绩效的对比优势,但是需要匹配单一产权和单类成员基础上的科层制管理方式。商品房小区在开发阶段汲取了单一产权与科层制的制度优势,但是在物业管理阶段,由于多元产权、多类成员以及去科层制使得原有的制度优势丧失,带来一系列问题。这些问题的解决,需要开放式的治理方式。
The establishment of the gated community is the imitation of the original unit compound. The unit compound has the comparative advantage of quality and performance, but it needs to be matched with the hierarchical management system which is based on the individual property owner and the members in single category. Commercial residential estate assimilate the institutional advantages of individual property owner and the bureaucratic system in the stage of development. But in the stage of property management, it loses the institutional advantages of the original system due to the multiple property owners, multiple category members and de-bureaucratization. This brings a series of problems. To solve these problems, we need an open system of community governance.
