摘要
军民融合深度发展背景下面对国防科技安全新威胁,加强国防科技安全保障相关立法建设有着重要意义,理论上可以深化科技法学和管理学相关领域研究,实践上可以完善科技安全立法体系、充分保障军民协同创新。当前与国防科技安全相关的法制保障领域还存在一些问题,如相关法规结构存在局限,缺乏系统性和全面性;保障国防科技安全的相关法律法规内容相对滞后且存在冲突;保障国防科技安全的法律内容应用性和操作性不足等。完善保障国防科技安全的法律,实现依法加强国防科技安全管理应该做到:明晰新形势下国防科技安全立法原则、完善优化国防科技秘密信息保护法规体系、优化国防科技场地和硬件设施安全保护法规体系、加强技术转移过程的国防科技信息安全立法建设。
Under the background of Civil - military Integration and new threats upon national technology safety, it is of great significance to strengthen the legislation construction of national defense science and technology security. In theory, it could deepen related research on the fields of the science technology law and the management science. In practice, it could optimize the science and technology security legislation system to fully safeguard Civil - Military Integration Technology Collaborative Innovation. Presently there are limitations in the relevant legal frameworks for the security of national defense science and technology, which are lack of systematic and comprehensive; The laws and regulations which ensure the security of national defense science and technology are relatively lagging and conflicting; There are also problems with the legal content that lacks applicability and operability. There are four requirements for completing the legislative principles of national defense science and technology security, and strengthening the safety management of national defense science and technology legally：Clarifying the legislative principle of national defense science and technology security under the new situation, completing regulatory system of secrets protection about national defense science and technology. Optimizing regulatory system of sites and hardware facilities about national defense science and technology. Strengthening the legislation of national defense science and technology information security in the process of technology transfer.
