摘要
随着社会分工越来越细化以及人们生活水平的提高,家政服务行业作为第三产业焕发了新的活力,但是家政服务行业的发展却存在着诸多的问题,其中从业人员作为劳动者的权益保障问题变得尤为突出。由于家政行业从业者本身具有的特点,他们的劳动保障与家政服务行业快速发展的实际情况极为不符。家政行业从业者劳动权集体保障的缺失,使得他们缺乏表达自身利益诉求以及争取个人合法权益的制度性通道,且相关领域的法律技术化问题仍然有待解决。
Along with the social division of labor and the improvements of people’s living standard,Domestic service industry is developing fast. As the third industry revitalized,but there are many problems,such as its practitioners as safeguarding the rights and interests of workers has become particularly prominent. Because of the characteristics of the domestic industry practitioners themselves,the actual situation of the domestic industry’s labor security and its rapid development is very inconsistent. Lack of collective protection of labor rights,making workers lack of expression of their own interests and the pursuit of individual legal rights and interests of the institutional channels,related areas of legal and technical issues still to be resolved.
